Reasons
Punishment of the crime
On April 23, 2012, the Defendant, a construction machinery facility leasing company C, and D’s concrete mixtures trucks under the name of the Defendant’s spouse, concluded a construction machinery facility leasing contract with the content of leasing facilities necessary therefor around September 4, 2013, and around September 2014, the Defendant demanded C to pay KRW 3,432,00,00 to the Defendant, which would not pay the said fees. In order to prevent the Defendant from paying the fees, the Defendant attempted to forge’s consent to the transfer of the registration of each concrete mixtures truck owned by D.
1. On September 19, 2014, the Defendant entered the form of a written consent for the transfer of registration of construction machinery posted on the website of the registered vehicle at the Defendant’s house located in Seo-gu Daejeon-gu Daejeon-gu, Daejeon-gu, into the “name of construction machinery” column, “F” column, “registration number” column, “D,” etc., and printed it into the “name of construction machinery” column, and then was rejected in advance to the “C representative (person)” side.
C For the purpose of exercising the seal affixed by the C representative, a letter of consent in the name of C, a private document on rights and obligations, was forged, and on the same day, an application for the registration of transfer was filed with the public official H who knows the forgery at the vehicle registration office located in the Jung-gu Daejeon, Daejeon, for the registration of transfer to the public official H who is aware of the forgery, submitted the forged consent as if it was duly

On September 26, 2014, the Defendant entered the form of a written consent for the transfer of construction machinery posted on the vehicle’s website at the Defendant’s office located in Seo-gu Daejeon Daejeon, Daejeon, into the “Name of Construction Machinery” column, “E” column, “registration number” column, and printed it into the “D” column, etc., and then was rejected in advance to the “C representative (person)” side.
C. For the purpose of exercising the seal of the C representative, the name of C, a private document on rights and obligations.
