1. 피고인 A 피고인은 2014. 7. 15. 15:00경 양주시 D에 있는 E회사 사무실에서 스마트폰 채팅 어플리케이션 ‘즐톡’에 접속하여 채팅을 통해 알게 된 청소년인 F(여, 14세)에게 성매수 대가로 10만 원을 주기로 약속하고, 같은 달 16. 17:00경 포천시 G에 있는 ‘H’이라는 상호의 중국음식점 앞 노상에 주차한 피고인의 I 싼타페 승용차 안에서 F와 만나 성매매 금액을 흥정하는 등 청소년에게 성을 팔도록 권유하였다.

2. 피고인 B 피고인은 2014. 7. 18.경 포천시 J에 있는 ‘K’ 모텔에서 스마트폰 채팅 어플리케이션 ‘즐톡’에 접속하여 채팅을 통해 알게 된 청소년인 F(여, 14세)에게 성매수 대가로 15만 원을 주기로 약속하고, 같은 날 14:30경 포천시 L에 있는 M모텔 200호에서 위 F와 1회 성교함으로써 청소년의 성을 사는 행위를 하였다.
