All appeals by the Plaintiff (Counterclaim Defendant) are dismissed.
The costs of appeal shall be borne by the plaintiff (Counterclaim defendant).
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. D, which had been put up by the Defendant on August 4, 1985, purchased 1,183 square meters of Pyeongtaek-si C forest from E on August 4, 1985, and completed the registration of ownership transfer under the Songwon District Court’s receipt No. 17712, May 6, 1985. 2) The forest land 1,183 square meters out of which was 380 square meters was divided into the public land in Pyeongtaek-si on June 28, 2002, and was divided into the public land, and was divided into Pyeongtaek-si F forest on June 29, 2002. The land classification was changed on February 25, 2005, and the remaining 803 square meters was the land of this case.
3) On November 23, 2012, the Defendant completed the registration of ownership transfer with respect to the instant land under the Songwon District Court’s registration office received on June 7, 2013, by reason of inheritance by consultation and division. (B) The Defendant stated that the Dongwon District Court’s registration office was completed the registration of ownership transfer with respect to the instant land under subparagraph 1 of Article 16925, which was located on June 7, 2013.
2) On March 15, 1985, the Deceased transferred his resident registration to the location of the instant house. 3) On the instant house, the Deceased completed the registration of initial ownership on August 21, 2013 as Songwon District Court’s Office of Registration of Bhutan (28034).
C. The deceased, such as the possession of the land in this case, is entitled to indicate “the appraisal map of the attached drawing” among the land in this case, and to connect each point in the order of 1,2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, and 13 to the portion “A” above 65.5 square meters above the portion “A”, ② 13, 12, 16, 15, and 13 above, and to the portion “B” above 6.0 square meters above the portion “A”, ③ 11, 10, 18, 17, and 11, and the portion “A” above 5.9 square meters above the portion “A”, ④ 19, 20, 21, 26, 222, and 19, in sequence, in the order of order.
