피고인은 2014. 9. 18. 11:40경 강원 고성군 C에 있는 피고인의 집 거실에서, 피해자 D(남, 56세)과 함께 술을 마시던 중 피해자가 돈을 내지 아니하고 짬뽕을 먹으려고 하였다는 이유로, 피해자에게 “음식 값도 안낸 놈이 음식을 먹냐, 이 새끼를 주느니, 차라리 개새끼를 주는 것이 낫지”라고 말하며 그곳에 있던 짬뽕 그릇을 집어 던지고, “이 새끼, 죽여버린다”라고 욕설을 하며 발로 피해자의 가슴 부위를 1회 걷어차 피해자를 바닥에 넘어뜨린 후, 주먹으로 피해자의 머리와 얼굴 부위를 10회 가량 때리는 등 피해자를 폭행하였다.
