A defendant shall be punished by imprisonment for a term of two years and two months.

The defendant shall be liable for damages in the amount of KRW 520,00,000 to the applicant C.

Punishment of the crime

[Criminal record] On October 19, 2016, the Defendant was sentenced to one year and six months of imprisonment for fraud at the Seoul Western District Court, and completed the execution of the sentence at the Seoul Southern District Court on October 9, 2017.

[2] Since the Defendant did not have goods such as a camera and Handphone, the Defendant did not have any intent or ability to send goods even if he received money from others as a price for goods.

On October 17, 2017, the Defendant posted a false statement to the effect that the Defendant would send a glare to the victim F who reported and contacted with the Internet site by accessing the Internet site to the “China and Highest countries” and selling the glare at the Internet site, and that the Defendant would send a glare to the victim F.

The Defendant received 600,000 won from the damaged person to the Defendant’s account as the price for goods on the same day.

As indicated in the attached list of crimes, the Defendant, including this, posted a notice to the effect that goods are sold on the Internet site at a cream room or telecom, etc. located in Gwanak-gu in Seoul Special Metropolitan City over 24 times from around that time to December 19, 2017, and received a remittance of KRW 11,121,000 in total to the Defendant’s account as the price for the goods by false statement to the effect that the Defendant would send money to the victims who reported the fact.

In this respect, the defendant, by deceiving victims, acquired financial benefits.
