Defendant shall be punished by imprisonment for a term of one year and six months.
Reasons
Punishment of the crime
On June 22, 2018, the Defendant was sentenced to ten months of imprisonment for fraud, etc. at the Seoul Northern District Court, and the execution of the sentence was completed on January 1, 2019.
"2019 Highest 135"
1. On January 28, 2019, the Defendant: (a) around the new village located in Mapo-gu Seoul, Mapo-gu, 90; (b) obtained a copy of C Bank C Bank C Bank C Bank CB card (D) whose victim was lost; and (c) did not take necessary procedures, such as returning it to the victim; and (d) embezzled as he/she thought he/she had.
2. On January 28, 2019, the Defendant violated the Computer, etc. Fraud and the Specialized Credit Financial Business Act: (a) around 17:42, 200, the Defendant settled KRW 120,000,000, total transportation charges of 122 times in total, from that time to February 18, 2019, in the red entry zone in Mapo-gu, Seoul, and the C Bank C Bank C Bank C Bank C Bank C Bank Card, as described in paragraph (1), in contact with subway entry terminal operated by the Seoul Metropolitan Transport Corporation.
Accordingly, the defendant obtained property benefits by inputting information without authority in the access terminal, etc., which is the information processing unit, and used lost debit cards.
3. Night-time theft of buildings;
A. On February 7, 2019, around 02:07, the Defendant intruded into “F” of the third floor of the above building on the ground that he was aware of theft of the new launch of the building in Gangnam-gu Seoul, Gangnam-gu, Seoul, and stolen the said building with an oral 1 turn on, 1,000,000, the market value of the victim G ownership located in the front entrance.
B. On February 13, 2019, at around 01:08, the Defendant intruded into the “F” of the third floor of the said building with his mind of thefting from the 01:08th floor of the said building. On the other hand, the Defendant: (a) turned down on an emergency warning 1,00,000 won at the victim H owned by the victim H located in the front entrance; and (b) turned down on an emergency warning 1,00,000 won at the market price.
