Reasons
Punishment of the crime
The Defendant is the head of the propaganda editing office of the E Trade Union located in Ulsan D (hereinafter referred to as the “instant Trade Union”) from December 1, 2015 to April 11, 2016, who has overall control over the affairs such as public relations of policies and publication of the instant Trade Union.
1. No one who violates the Public Official Election Act by posting a poster under the illegal means shall post any poster, photograph, document, picture or printed material and others similar thereto which contain the contents supporting, recommending or opposing a candidate (including a person who intends to become a candidate) without going through the provisions of the Public Official Election Act from 180 days before the election day to the election day, or which indicate the candidate's name;
Nevertheless, from April 5, 2016 to August 8, 2016, the Defendant posted 200 copies of the above poster at the bulletin board of the cooperation staff support department, the plant business entrance, etc. in E, by posting a poster (a 60 cm, 84 cm) where the names and photographs of the candidates belonging to Ulsan Ffree G, the J candidates belonging to Ulsan HI Party and Lless Lless Lless L belonging to Ulsan, and the names and photographs of the candidates belonging to Ulsan F.m., and the posters (a 60 cm, 84 cm, cm in length), under the title of “Ulsan Democratic Labor gun and EM support candidates who are Nationless,” in front of the restaurant of the above E production technology center.
As a result, the Defendant posted a poster containing a photograph indicating the name of the G candidate, etc. in order to influence the above election from April 13, 2016 to April 180, 2016, which was the 20th National Assembly member election day.
2. No person who violates the Public Official Election Act due to the installation of banner shall install any banner except those prescribed by the Public Official Election Act, in order to influence an election from 180 days before the election day to the election day;
In such cases, clarifying the name of a political party or any content by which it can be inferred shall be deemed to be aimed at exerting an influence on the election.
