Reasons
Punishment of the crime
1. No one shall distribute, post, spread, show or run an advertisement, letter of personnel management, poster, photograph, document, picture, picture, printed matter, recording or video tape and others similar thereto, which include contents supporting, recommending or opposing a political party or candidate, or which indicate the name of a political party or candidate's name, in order to influence the election from 180 days before the election day to the election day;

2. Nevertheless, on July 30, 2014, around 09:50, the Defendant spreads the text files and photographs, such as paragraph (1), to the Defendant’s cell phone (E) by transmitting them to the right holder of 124 persons.
