Defendant shall be punished by a fine of KRW 700,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. No person who violates the Public Official Election Act by installing or posting diskettes shall install, display, post or distribute advertisements or advertising facilities, except for those prescribed by the Public Official Election Act, in order to have an influence on the election from 180 days before the election day to the election day;

Nevertheless, on June 2, 2018, at the entrance of D in front of C around 09:39, the Defendant installed at the entrance of D, for G, a candidate for the E-member of the local basic council (F party) in the election of local council members of the 7th local basic council, one kicket on which G’s face, name, symbol, name of party name, etc. are indicated.

As a result, the defendant installed and posted a scket, which is an advertisement to influence the election from 180 days before the election day to the election day.

2. No person who violates the Act on Election of Public Officials by posting a poster shall distribute, affix, spread, screen, or display any advertisement, letter of personnel management, poster, photograph, document, drawing, printed matter, recording, video tape, and others similar thereto, with the exception of those as prescribed by the Public Official Election Act, which include the contents supporting, recommending, or opposing a political party or candidate, or which indicate the name of a political party or candidate, from 180 days before the election day to the election day;

Nevertheless, on June 2, 2018, at the entrance of D in front of C around 09:48, the Defendant attached one poster stating the face, name, strength, and symbol of G to G for G, who is a candidate of the E member of the local basic council (F party) in the election of the 7th local basic council member, at the entrance of D in front of C.

Accordingly, the defendant posted a poster indicating the candidate's name to influence the election from 180 days before the election day to the election day.
