Punishment of the crime
피고인은 피해자 C과 굼벵이 농장을 공동으로 운영하였던 사람으로서, 사업에 실패하여 투자금을 회수하지 못하게 되자 피해자를 비방할 목적으로 허위의 글을 게시하기로 마음먹었다.

3. 피고인은 2017. 12. 6. 경 불상의 장소에서 ‘D’ 게시판에서 알게 된 굼뱅이 사업자들의 전화번호를 확인하고 약 40 여명에게 문자 메시지로 위와 같은 내용의 허위의 사실을 전송하였다.
