Punishment of the crime

1. On December 2014, the Defendant, at the beginning of the crime (Embezzlement of possession), embezzled the victim’s thought to have possession without following necessary procedures, such as acquiring the resident registration certificate lost by the victim C and the color reflectors equivalent to 150,000 won at the market price, even if he/she acquired the resident registration certificate lost by the victim C and returned it to the victim.

2. On December 17, 2014, around December 17, 2014, the Defendant presented to the employees of the above store as if they were their resident registration certificates, as stated in paragraph 1, at the mobile phone store located in the Nam-gu Seoul metropolitan area, the Defendant: (a) around December 17, 2014, submitted that “F” was written in the subscriber column of the service new contract form kept there; and (b) submitted the forged new contract form to the said employees as if they were genuinely prepared; (c) “C” and “F” were written in the subscriber column of the service new contract form kept there; and (d) submitted the forged new contract form to the said employees as if they were genuine.

Accordingly, the defendant denied the official document, and forged and exercised one copy of the mobile phone service new contract in the name of C, which is a private document on rights and obligations, for the purpose of uttering.

3. Crimes committed on February 26, 2015;

A. The Defendant, around 14:00 on February 26, 2015, at the “J” mobile phone store operated by the victim I located in Seodaemun-gu Seoul, Seodaemun-gu, Seoul, the Defendant presented the said I the C’s resident registration certificate as if he had been one of his resident registration certificates, and indicated “C” and “F” in the column of the subscriber in Chapter II of the new site of the service contract kept therein as “C” and “date of birth (which is obvious that the “resident registration number” recorded in the indictment is a clerical error)” in the column of the subscriber in Chapter II of the new site of the service contract. After each private person committed each other on his name, two copies of the forged new contract are authentic.
