A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The Defendant was sentenced to one year of imprisonment for the crime of forging a private document, etc. at the Incheon District Court on January 7, 2014, and the execution of the sentence was terminated on April 30, 2014. On January 15, 2015, the Incheon District Court sentenced two years of suspended execution to 8 months of imprisonment for the crime of forging a private document, etc., and the judgment became final and conclusive on January 23, 2015. On June 3, 2016, the Daejeon District Court sentenced the Defendant to one year of imprisonment for a violation of the Act on the Control of Narcotics, etc. at the Daejeon District Court on September 8, 2016.

[Criminal facts]

1. Crimes committed on March 8, 2016;

A. On March 8, 2016, the Defendant embezzled the lost property, without following necessary procedures, such as returning it to the victim, in a stone market located in the Namdong-gu Incheon Metropolitan City, Namdong-gu, Incheon, and even though the victim B acquired one copy of the resident registration certificate lost by the victim B, the Defendant embezzled the property that left the possession of the victim.

B. On March 8, 2016, at around 19:30, the Defendant’s unlawful uttering of official documents, presented that the resident registration number of B, which was obtained in the name of the head of the Gun budget, was a Defendant’s resident registration certificate, and subsequently presented it to the public document in the name of the Defendant’s resident registration certificate, at around 19:30, in E operated by D, which is located in Seoul, Nam-gu, Incheon, Seoul, for the purpose of opening a mobile phone from F, who is an employee of the place, to produce necessary identification cards when opening a mobile phone.

The Defendant, at the time, place, and place indicated in the above paragraph (b) above, stated “B”, “G”, and “B” as “B” in the customer information column of the lele mobile entrance that is kept in the space using the tampial, and forged one copy of the application form in the name of B, which is a private document concerning rights and obligations, for the purpose of signing and exercising the applicant’s “B” in the applicant column, and issued the forged application form as if it were duly concluded.
