A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. Fraud;

A. On January 26, 2019, the Defendant, around 02:25, 2019, demanded the Geumcheon-gu Office located in 73-gil-gu, Geumcheon-gu, Seoul Special Metropolitan City, at the 1822 South-gu Seoul Special Metropolitan City Southern-ro, to move into a cab for business purpose operated by the victim C as a guest, and then the victim would normally pay the taxi fee to the victim, as he would normally pay the taxi fee.

However, the defendant did not have the intention or ability to pay taxi charges.

Nevertheless, the Defendant, by deceiving the victim as such, had the victim operate the taxi to the destination, and did not pay 23,660 won of the taxi fee, thereby acquiring financial benefits equivalent to the same amount.

B. On July 12, 2019, around 11:51, 2019, the Defendant: (a) opened a F-business taxi operated by the victim E with a smartphone fishing system “B” at a place where it was located in the Nam-gu, Incheon Metropolitan City (hereinafter referred to as the “Seoul-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-si; (b) boarded the victim as a customer

However, the defendant did not have the intention or ability to pay taxi charges.

Nevertheless, the Defendant, by deceiving the victim as such, had the victim operate the taxi to the destination, and did not pay 20,100 won of the taxi fee, thereby acquiring financial benefits equivalent to the same amount.

C. On July 18, 2019, the Defendant, at around 16:28, around 18, 2019, sent a J-business taxi operated by the victim I to “H” in the vicinity of “H” located in Hanam-si, Hanam-si, and boarded a J-business taxi operated by the victim I, took the taxi as a customer, and then took the taxi back to the victim as if he would normally pay the victim the taxi fee.
