Reasons
Punishment of the crime
1. Around 11:30 on June 17, 2013, the Defendant violated the Road Traffic Act (unlicensed Driving) and driven a DNA-XG car without obtaining a driver’s license from the house of the Defendant located in Suwon-si, Suwon-si, Suwon-si, Seoul to around 13:00 on the same day, from around 40km to the front road of Guro-gu, Guro-gu, Seoul.
2. Around 13:00 on June 17, 2013, the Defendant: (a) driven the said taxi and driven the said taxi on a four-lane road in front of the 413-1st head of the Guro-gu Seoul Metropolitan City, Guro-gu, toward the direction of the new road basin from the underground streets; and (b) driven the four-lane along the 4-lane, while not operating the brake system in a traffic signal line due to negligence; (c) led the backer of the Fcab in front of the said vehicle, which was parked in the signal line, to the front end of the said vehicle; and (d) led the said taxi to damage the repair cost to KRW 408,833,00 on the front end of the said vehicle and escaped the vehicle at the site without any measure.

Relevant criminal facts: (a) Articles 148, 54(1), 152 subparag. 1, and 43 of the Road Traffic Act; (b) Articles 148, 152 subparag. 1, and 43 of the same Act; and (c) each of the fines [the defendant was sentenced to a three-year suspended sentence for a violation of the Road Traffic Act at the Daejeon District Court on December 22, 2011; (d) the above judgment became final and conclusive on December 30, 201; and (e) on December 12, 2011, the same court was sentenced to a two-year suspended sentence for a violation of the Road Traffic Act (licensed driving) and was sentenced to a suspended sentence on May 17, 2012; (e) the two cases were all committed at the same time; and (e) the latter was prosecuted for a violation of the Road Traffic Act (the latter two-year suspended punishment due to a violation of the Road Traffic Act; and (e) there is a high possibility of larceny in each case.
