Reasons
1. Basic facts
A. The content of the instant project is the establishment of a project for the establishment of a high-tech regional information and communications network (hereinafter “instant project”) to be managed by the Integrated Control Center, CCTV, self-communication facilities, IP-Techn, etc. in the area of crime prevention, road traffic prevention, traffic safety control, illegal parking control, pollution surveillance, forest fire, disaster, park, park, children’s playgrounds surveillance, administrative advertisement, control of illegal dumping of garbage, etc. in the U-City Integrated Control Center.
B. The construction work of this case (hereinafter “the construction work of this case”) was contracted to a special purpose corporation established on August 18, 2009 to operate the business of this case, which was set at KRW 14,329,700,000 (including additional tax; hereinafter the same shall apply) and the construction period from September 16, 2009 to March 15, 2010 (hereinafter “the construction work of this case”).
(2) On September 16, 2009, K Co., Ltd subcontracted the instant construction work with the price of KRW 5,762,130,000, which was set at KRW 5,762,130,000. On October 28, 2009, K Co., Ltd transferred the said subcontract to Asia.
(3) 아시아나아이디티는 미래보안기술에 이 사건 건설공사를 대금 5,081,151,000원에 재하도급 하는 내용의 2009. 12. 2.자 프로젝트 계약서를 작성하여 주었고, 미래보안기술은 옥가정보통신(피고 자바네트웍스의 변경 전 상호임, 이하 ‘피고 자바네트웍스‘라 한다)에 이 사건 건설공사를 대금 2,489,300,000원에 재차 하도급 하는 내용의 2009. 12. 23.자 공사표준계약서를 작성하여 주었다.
(4) 피고 자바네트웍스는 원고에게 이 사건 건설공사 중 별지 산불감시 물량내역서 기재 공사(이하 ‘이 사건 공사’라 한다)에 관하여 대금을 341,000,000원으로 하는 내용의 2009. 12. 3.자...
