1. Basic facts

A. C. On September 16, 2009, Defendant Kit awarded a subcontract for the instant construction work with the price of KRW 5,762,130,000 (including value added tax) to Bitex CC Co., Ltd., and on October 28, 2009, BitC Co., Ltd transferred the said subcontract to Asia (hereinafter “ABD”)

아시아나아이디티는 피고 주식회사 미래보안기술(이하 ‘피고 미래보안기술’이라 한다)에게 이 사건 공사를 대금 5,081,151,000원(부가세 포함)에 재하도급하기로 하는 내용의 2009. 12. 2.자 프로젝트 계약서를 작성하여 주었고, 피고 미래보안기술은 옥가정보통신 주식회사(피고 주식회사 자바네트웍스의 변경 전 상호임, 이하 ‘피고 자바네트웍스’라 한다)에게 이 사건 공사를 대금 2,489,300,000원(부가세 포함)에 재차 재하도급하기로 하는 내용의 2009. 12. 23.자 공사표준계약서 및 공사대금을 2,842,066,700원(부가세 포함)으로 증액하기로...
