Defendants shall be punished by imprisonment for ten months.

However, this judgment shall be given to Defendant B for a period of two years from the date of confirmation of this judgment.

Punishment of the crime

Defendant

A is a person who operates a ship brokerage business to introduce used ships built in Japan to domestic shipping companies, and the defendant B is a person who operates the (ju) E, a shipping company located in Busan Jung-gu D. D. 302.

1. The Defendants jointly committed a crime with F are unable to transport coastal cargo with a vessel of 15 years or more (Public Notice on Restriction of Age of Inland Cargo Line: Notice No. 2012-533 of Ministry of Land, Transport and Maritime Affairs: Ministry of Land, Transport and Maritime Affairs) and conspired to exercise a Japanese nationality certificate by altering the vessel’s nationality certificate, as the fleet G (No. Ha: H) that Defendant A arranged in Japan, with well aware of the fact that he was unable to transport coastal cargo with a vessel of 15 years or more.

The Defendants, around December 2009, instructed the above state office (E) office, Defendant B, F of the above company accounting staff, ordered the above company accounting staff F to work for Defendant A, and Defendant A instructed the above F to alter the contents by using the normal certificate of ship’s nationality that he received in Japan, using the computer and slickner.

2. On January 18, 2010, the Defendants’ co-offenders issued a provisional certificate of ship’s nationality for the above G (No. 1: H.) to the Korean consulates located in the Republic of Korea in the Republic of Korea, and to the O, performing the duties within the Japan of the Pyeongtaek Defendants, and to the above changed Japan’s certificate of ship’s nationality for the above G (No. 1: H.).
