A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. During the period from May 7, 2014 to November 26, 2014, the Defendant is a person in charge of the opening of a new mobile phone terminal and the receipt of a mobile phone terminal at the KT agency of “E operated by the former C victim D” while he/she became aware of.

1. As described in the foregoing agency, 20 mobile phone terminals equivalent to the total market value of KRW 16,093,000 were embezzled.

B. On May 29, 2014, the Defendant: (a) posted one of the USIM chips (Serial No. I) at the market price of 9,900 won at the above agency’s work on a mobile phone terminal (SM-G90K); and (b) arbitrarily takes the method of pretending that the mobile phone was normally sold as described in the above paragraph (a); (c) disposes of the same from that time to September 30, 2014 with the aforementioned mobile phone sales; and (d) disposed of the same from that time to September 30, 2014.

1. As described in the foregoing agency embezzled 16 USIM chips equivalent to the total market value of 158,400,000 won.

(c)

On June 26, 2016, the Defendant: (a) arbitrarily brought up two mobile phone terminals (AIP5S-16GD) with a total market value of KRW 1,628,000 in total; (b) the Defendant disposed of and embezzled the mobile phone sales from around that time, and then disposed of to Handphone sales.

(d)

The defendant in relation to the charge for the receipt of Handphones is from customers at the above agency on June 10, 2014.
