Reasons
Punishment of the crime
No one shall exchange or re-purchase any tangible or intangible result obtained through the use of game water, and no one shall engage in speculative activities as a business by using any speculative machine.
Defendant
A had been operated in the name of “H Gameland” from January 2016 to the name of “H Gameland” in Chungcheongnam-si. A, around July 6, 2016, had the game room operated in the name of “H Gameland” (hereinafter referred to as “game room”), and had Defendant D and the relevant game room exchanged the score obtained by the customers who sought the head of the said game room in cash to increase their profits, and recruited them to have the fee received from the customers divided.
In addition, Defendant A employed Defendant B (from July 6, 2016 to May 15, 2017) and Defendant C (from January 6, 2017 to May 15, 2017) among themselves and siblings, and entrusted the overall management of the above game hall, Defendant A paid money necessary for exchange to the above D, and had the said D perform duties, such as recording the details of exchange in the account book.
Accordingly, from July 6, 2016 to May 15, 2017, the Defendants established a total of 70 units of the above game room, including 20 units of the "Yengdo" game, and 50 units of the "Yungdo" game, provided them to many unspecified customers, and exchanged the remaining points (in the case of points 10,000 points, 9,000 won in cash) after deducting 10% of the charges from those acquired using the above game water.
As a result, the Defendants conspired to engage in speculative activities using game water such as exchange of tangible and intangible results and speculative gaming machines.
