A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 2017, the Defendant purchased Jin-si C Apartment Complex D in the name of Jin-si B, and at the time, the tenant E was living in two years (from February 23, 2017 to February 22, 2019) and the lease deposit amount of KRW 270 million.

As above, the Defendant: (a) forged a lease agreement under which tenants E live in the rental deposit amount of KRW 20 million when considering the apartment market price of KRW 270,000,000 for the deposit money for the lease of the above apartment unit D; and (b) decided to lend the loan to the above apartment unit D as security.

1. Around March 15, 2018, the Defendant forged a private document on the right and duty of use in the name of E, a private document for the purpose of arbitrarily recording the personal information in the lessor column, the lessee column, the lessee column, and then affixed a new seal on his/her own, in the restaurant run by the Defendant, located in the Masan-si Member F, Changwon-si, Seoul-si, by means of forging a false real estate lease contract in the column for deposit for the real estate lease contract for the above apartment D, and transmitting the photograph thereof to G mobile phone by a credit service provider who is unaware of the forgery.

2. On March 15, 2018, the Defendant: (a) around the first floor of the I Hospital located in Changwon-si, Changwon-si; (b) the victim G had the tenants live in the victim G with the deposit of KRW 20 million and KRW 800,000,000 per month; (c) if the said apartment is leased KRW 160,000,000,000,000,000,000,000,000,0000,000,000,000,000,000,000,000,000,000,000,000,000,0000,000,000,000)

However, in fact, the tenant E was 270 million won prior to the lease deposit, and the debt amount was 100 million won at the time, and the deposit was 200 million won.
