피고인은 2013. 2. 14. 23:35경 서울 영등포구 대림동 이하 불상의 우체국 앞 노상에서 시비가 있다는 112신고를 접수하고 구로경찰서 C파출소 소속 피해 경찰관인 경장 D 외 1명이 현장 출동하여 처리 절차 등을 설명하자 갑자기 "야 이 씹새끼야, 개새끼야, 내 형이 서울고검 검사인데 너 조심해라"고 하면서 오른쪽 발로 D의 좌측 허벅지부위와 종아리부위를 각 1회씩 걷어차고, 피고인을 현행범인으로 체포하여 112순찰차량 뒷좌석에 승차시켜 옆 좌석에 D가 동승하자 갑자기 "너는 좇됐어"라고 말하며 오른 주먹으로 D의 얼굴 좌측 이마 부위와 관자놀이 부위를 각 1회씩 때리는 등 폭행하여 경찰관의 정당한 112신고 처리업무를 방해하였다.
