피고인은 2012. 11. 07. 00:10경 인천 부평구 B에 있는 C여인숙 출입계단 내에서 C여인숙 업주와 말다툼을 하던 중, 이를 제지하기 위해 출동한 경찰관 D 및 위 업주가 있는 자리에서 고소인 E에게 “야이 씨발놈아, 짭새 따위가 민중의 지팡이냐, 꺼져 씨발 놈들아”라고 큰소리로 말하여 공연히 고소인을 모욕하였다.
