1. 피고인 A - 상해 피고인은 2014. 11. 23. 07:45경 의정부시 D에 있는 E식당 앞 노상에서, 피해자 F(28세)의 일행인 G가 들고 있다가 떨어뜨린 장미꽃을 발로 밟아 피해자와 시비하던 중, 손바닥으로 피해자의 머리를 수회 때리고, 발로 피해자의 엉덩이와 다리부위를 수회 걷어찼다 이로써 피고인은 피해자에게 약 2주간의 치료가 필요한 안면 및 두부 다발성 타박상 등을 가하였다.

2. 피고인 A, B - 폭력행위등처벌에관한법률위반(공동상해) 피고인 B는 전항 일시 장소에서, 위 F의 일행인 피해자 H(28세)이 말리려고 하자 피해자의 옷을 잡아끌어 넘어뜨리고, 발로 넘어진 피해자의 얼굴 부위를 수회 걷어차고, 피고인 B의 일행인 피고인 A은 이에 가세하여 발로 넘어진 피해자의 얼굴 부위를 수회 걷어찼다.
