피고인은 2016. 9. 5. 18:50 경 서울 강북구 B에 있는 C 2 층에서 지인 자녀의 결혼식 뒤풀이에 참석하여 피해자 D(47 세) 등 일행과 술을 마시던 중 전날 건축 현장에서 있었던 일로 피해자와 언쟁하던 중 기분 나쁘다는 이유로 마시고 있던 맥주 컵을 집어 들고 피해자의 이마 부위에 던지고, 계속하여 주먹으로 피해자의 얼굴, 몸체 부위를 수회 때리고 넘어뜨려 피해자의 이마 부위가 찢어져 40 여 바늘을 꿰매게 하는 등 피해자에게 치료 일수 미상의 이마 부위 열상을 가하였다.
