A defendant shall be punished by imprisonment for not less than one year and six months.

Criminal facts

On April 26, 2012, the Defendant sentenced the Suwon District Court to two years of imprisonment for the crime of fraud, bodily injury, assault, and obstruction of performance of official duties and fine of one million won, and completed the execution of the sentence in Daejeon Prison on October 21, 2013.

1. Fraud;

A. On June 15, 2014, at around 12:55, the Defendant: (a) placed an order for alcoholic beverage and food at the E-cafeteria operated by the victim D in Suwon-si, Suwon-si; and (b) had been issued a drinking and food delivery, as if he would pay the price.

However, the defendant did not have any intention or ability to pay the price because he did not have cash or credit card at all.

As above, the Defendant was issued a total of 23,00 won and food equivalent to the victim, by deceiving the victim as above, thereby getting the victim involved.

B. On June 26, 2014, around 01:30, the Defendant: (a) ordered a H restaurant where the victim G in Suwon-si F works for the victim G, who received alcohol and food delivery while placing an order for alcohol and food; and (b) was committed as if he would pay the price.

However, the defendant did not have an intention or ability to pay the price because he did not have cash or credit card.

The Defendant, by deceiving the victim as above, received a total of KRW 10,000 from the victim alcoholic beverages and food equivalent to the amount of KRW 10,00,00.

C. At around 15:20 on June 29, 2014, the Defendant: (a) ordered alcohol and food at the Kju shop operated by the Victim J in Suwon-si, Suwon-si; and (b) received the delivery of alcohol and food as if he would pay the price.

However, the defendant did not have an intention or ability to pay the price because he did not have cash or credit card.

The Defendant, by deceiving the victim as above, received a total of KRW 15,00,00, including chickens and food from the victim.

2. Violence;

A. On July 16, 2014, around 19:50, the Defendant ordered the Defendant to enter the NKa Paf, which is administered by the victim M(M, 61 years of age) L in Suwon-si, Suwon-si, for drinking.
