Defendant

A is a public official who was in office as a policy assistant for D Minister from November 7, 2014 to January 13, 2016, and was registered as a preliminary candidate belonging to the F Party in the 20th National Assembly election in effect as of April 13, 2016, but was fallen from the intra-party competition, and Defendant B is a person who was in office of Defendant A and a electorate residing in G.

1. A person who intends to be a candidate for the joint election of the Defendants shall not make a contribution act for a person in the constituency concerned, or an institution, organization or facilities, or a person having relations with the electorate, or an institution, organization or facilities, even if outside the constituency concerned, and no person shall make a contribution act for the person who intends to be a candidate; and

Nevertheless, the Defendants planned to provide food by creating a meal site in order to raise public relations, recruit party members, and appeal for support by gathering local post-ship and scambling, and demanding the promotion of Defendant A’s public relations, recruitment, and election campaign.

B는 2015. 10. 3. 19:00경 H에 있는 I 식당에 J, K, L, M, N, O, P, Q, R, S, T를 불러 모으고 피고인 A에게 연락하여 식당에 오도록 하고, 피고인 A은 식사 자리에 모인 사람들에게 “작년에 U시장 선거에 출마했다가 떨어졌었다. 이번 20대 국회의원선거에 출마를 준비하고 있고, 마지막 도전이니 열심히 해보겠다. U는 젊은 사람이 부족한데 살기 좋은 교육도시로 만들어보겠다. 잘 부탁한다.”고 발언하고, 피고인 B는 “우리가 잘해서 뭔가를 보여줘야만 A이 선거에서 당선될 수 있다.”고 말하는 등 지지를 호소하며 참석자들에게 닭볶음탕, 주류 등 음식을 제공하고 음식 대금 164,000원을 결제하였다.
