A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

From March 2017 to June 19, 2018, the Defendant served as a nursery teacher at C Child Care Center located in Ulsandong-gu B, Ulsan-gu, and from March 2018, the Defendant was in charge of victim E (n, 2 years of age), F (n, 2 years of age), and 1 years of age.

1. On April 10, 2018, around 11:50 on April 10, 2018, the Defendant: (a) transferred the victim’s hand to another child and toy; (b) transferred the victim’s hand; (c) 11:53; and (d) 11:53.
