1. Defendant A

(a) The defendant shall be punished by imprisonment with prison labor for ten months;

(b)Provided, That the above punishment shall be imposed for two years from the date this judgment became final and conclusive.

B은 부산 수영구 N에 있는 O어린이집의 원장이고, 피고인 A, C는 위 어린이집 쑥쑥반(만 1세반)의 보육교사이다.

1. Defendant A

가. 피고인은 2013. 4. 17. 12:12경 O어린이집 쑥쑥반 교실에서 피해자 G(여, 1세)이 낮잠 시간에 잠을 자지 않고 칭얼댄다는 이유로 화가 나 피해자의 머리가 흔들릴 정도로 바닥에 거칠게 눕힌 다음 이불로 피해자의 얼굴까지 덮어 수 분간 방치하고, 계속하여 피해자가 잠을 자지 않자 피해자를 거칠게 끌어낸 다음 피해자를 던지다시피 바닥에 눕히고 이불로 피해자의 얼굴까지 덮어 아동인 피해자의 신체에 손상을 주고 정서적으로 정신건강 및 발달에 해를 끼치는 학대행위를 하였다.

나. 피고인은 2013. 4. 18. 15:14경 O어린이집 쑥쑥반 교실에서 피해자 L(1세)이 가만히 있지 않고 교실을 돌아다닌다는 이유로 화가 나 손바닥으로 피해자의 등을 2회 세게 때려 아동인 피해자의 신체에 손상을 주는 학대행위를 하였다.

다. 피고인은 2013. 4. 18. 15:31경 O어린이집 쑥쑥반 교실에서 피해자 G이 하루 종일 칭얼대고 기저귀를 갈려고 하지 않는다는 이유로 화가 나 손으로 피해자의 등을 2회 세게 내리치고 피해자를 거칠게 바닥에 눕혀 피해자에게 약 2주간의 치료가 필요한 등 부위 타박상 등의 상해를 가하고, 동시에 아동인 피해자의 신체에 손상을 주는 학대행위를 하였다.

2. Defendant B

A.
