A defendant shall be punished by imprisonment for not less than eight months.

The application for compensation of this case is dismissed.

Punishment of the crime

1. On June 2009, the fraud defendant made a false statement to the victim C at a gallon department store located in Seogalian, Seo-gu, Daejeon, Daejeon, in June 2009, stating that "The above investment product is a product that can be protected by the Depositor Protection Act, and is a product that can be protected by the Depositor Protection Act."

However, at the time of the instant case, the Defendant did not have invested KRW 1 billion in the Korean Exchange Securities, and attempted to lend the said money from the victim to D again, so even if receiving money from the victim, the Defendant did not have any intent or ability to pay the principal and interest of the investment to the victim by investing it in the Korean Exchange Securities.

The Defendant received delivery of KRW 10 million on June 11, 2009 and KRW 10 million on June 26, 200 on the account number E in the name of the Defendant from the victim.

Accordingly, the defendant was given property by deceiving the victim.

2. Around July 2009, the defrauded made a false statement to the victim C at the location described in paragraph 1 of the early July 2009 Police Officer, stating, “it is possible to be protected by the Depositor Protection Act, such as Korean currency investment securities, with the same invested goods as Korean currency investment securities.”

However, the Defendant did not have invested in our investment securities. The Defendant received money from the victim and attempted to invest in F Co., Ltd. F (hereinafter “F”), which is a fund-raising company without delay, and even if receiving money from the victim, the Defendant did not have the intent or ability to pay the principal and interest of the investment to the victim by investing it in our investment securities.
