1. Basic facts

A. The Plaintiff is the owner of each land listed in attached Table 1 List No. 1 (hereinafter “instant land”). The Plaintiff is the owner of each land listed in attached Table No. 1 List No. 1 List No. 2, and the Defendant is the owner of each land listed in attached Table No. 1 List No. 2 (hereinafter “instant land”). The Defendant is the owner of each land indicated in attached Table No. 1 List No. 4,434 square meters adjacent to the northwest-si, Seopo-si, and Seopo-si D (hereinafter “Defendant land”).

나. 피고는 이 사건 제1 토지 중 별지 제2 도면 표시 ㄱ, ㄴ, ㄱ1, ㅎ, ㅍ, ㅌ, ㄱ의 각 점을 순차로 연결한 선내 ‘나’ 부분 298㎡(이하 ‘이 사건 제1 계쟁 토지’라고 한다) 지상에 감귤나무 41그루(이하 ‘이 사건 제1 수목’이라고 한다)를, 이 사건 제2 토지 중 별지 제3 도면 표시 ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㅌ, ㅂ의 각 점을 순차로 연결한 선내 ‘나’ 부분 16㎡(이하 ‘이 사건 제2 계쟁 토지’라고 한다) 지상에 삼나무 20그루(이하 ‘이 사건 제2 수목’이라고 한다)를 각 식재하여 소유하면서 이 사건 제1, 2 계쟁 토지를 각 점유사용하고 있다.

According to the above facts of recognition, the defendant is obligated to collect the title Nos. 1 and 2 of this case from the plaintiff seeking the removal of interference with ownership as the owner of the land in the first and second disputes of this case and deliver the land in the first and second disputes of this case to the plaintiff.

According to the court's entrustment of surveying and appraisal with respect to the Korea Land Information Corporation's branch, the title No. 2 of this case is not planted on the boundary between the land No. 2 of this case and the defendant's land, but on the ground of the land No. 2 of this case, it can be acknowledged that the land of this case was invaded on the land of this case.
