A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2019. 10. 초순경 성명불상자로부터 ‘내가 지시하는 대로 게이트웨이, 에그, 노트북, 보조배터리, 어댑터 등 통신장비를 설치하고 공유기에 유심을 넣어 인터넷으로 신호가 잡히게 해주면 2주에 한번씩 150만 원의 수당을 지급하겠다’는 제안을 받고 승낙하였다.

1. No one may intermediate another person's communications through telecommunications services provided by a telecommunications business operator, or provide it for any third person's communications;

Nevertheless, around October 17, 2019, the Defendant installed communications equipment as a way to inform the winners of the names in Gyeyang-gu and underground C of the name in Incheon Gyeyang-gu, and then changed the Chinese phone numbers of the names in distress to the domestic mobile phone numbers in connection with Nowon-gu. From that time to November 8, 2019, the Defendant moved to Incheon City-si, by moving the equipment to D Lasta and installing it in the same manner, and finding out the place where it is easy to receive signals.

Accordingly, the defendant conspireds with the name-based party and mediated another person's communication through telecommunications services provided by telecommunications business operators.

2. A person who intends to operate a key communications business shall register with the Minister of Science and ICT after preparing financial and technical capabilities, plans to protect users, and other matters prescribed by Presidential Decree, including a business plan, as prescribed by Presidential Decree.

From October 17, 2019 to November 8, 2019, the Defendant installed communications equipment and installed a relay office in Incheon Gyeyang-gu, Incheon, the underground Cho Lake, and Incheon City, and mediated communications by linking the numbers transmitted by the namesd parties in China to the domestic mobile phone numbers.

Accordingly, the defendant in collusion with the person who is not registered with the Minister of Science and ICT.
