1. The plaintiff's claim is dismissed.

1. On June 30, 2009, the Plaintiff entered into an insurance contract with the Defendant as the insured (hereinafter “instant insurance contract”) with the same content as the attached Form [Indication of the Insurance Contract] as the insured.

The Defendant was hospitalized in a hospital for the total of 315 days from February 17, 2010 to September 5, 2014, as indicated in the following specifications of payment of insurance proceeds, and received medical treatment from the Plaintiff in total of 38,651,218 according to the insurance contract of this case.
