A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

The Defendant was a person who was a business owner of the “E Gameland” located in Busan-gu D.

1. No one shall provide game products for the distribution or use, the contents of which are different from those of the rating, or display or keep such products for such purposes;

From October 11, 2012 to August 20, 2013, the Defendant operated a juvenile game providing business with the trade name “E Gameland”, the Defendant: (a) opened a three game software using the game user’s game providing business; (b) divided the three options by searching for an selective container within a given time; and (c) installed 40 game using the method of discharging free games upon completion of the five stages by giving an opportunity for a sponsor game; and (d) completing the five stages, the Defendant installed 40 game software using the method of selling free games.

피고인은 위 게임장을 찾은 불특정 다수의 손님들에게 게임기 자동진행장치인 속칭 ’똑딱이‘를 제공하여 손님들로 하여금 게임기 버튼 위에 이를 올려놓고 자동으로 실행되게 하여 게임 이용자의 능력과 상관없이 우연의 결과에 의해 경품이 배출되도록 하는 방식으로 이용에 제공하였다.
