1. It is confirmed that the rest of the plaintiffs except the plaintiff X is the defendant's clan member.

2. Plaintiff X’s claim.

1. The gist of the plaintiffs' assertion is that the defendant, who is a member of the clan of the defendant's clan, who is the member of the defendant's clan, the "AE" (AF) of the defendant's 17-year-old descendants as a joint ancestor, denied the status of the plaintiffs' clan members by asserting that the defendant is a member of the clan of the defendant's clan, and that the defendant is the member of the defendant's clan.

가. 어느 종중을 특정하고 그 실체를 파악함에 있어서는 그 종중에서 봉제사의 대상으로 삼고 있는 공동선조가 누구인가가 가장 중요한 기준이 되고 이를 기준으로 하여 종중 구성원의 범위도 확정될 수 있는바, 갑 제1, 4 내지 20호증(각 가지번호 포함, 이하 같다), 을 제2 내지 6호증의 각 기재, 증인 AG의 증언, 이 법원의 양주시장에 대한 사실조회 결과에 변론 전체의 취지를 종합하여 알 수 있는 아래와 같은 제반 사정에 비추어 보면, 피고 종중은 AC 14세손 AD 이하 공동 선조의 분묘수호와 제사 및 종중원 상호간의 친목 등을 목적으로 하여 AD의 손자인 AH(큰댁 계열), AI(작은댁 계열)의 후손들로 구성되어 AD을 공동선조로 하는 종중으로 봄이 타당하고, 이와 전제가 다른 피고의 주장은 이유 없다.

1) AC 시조 14세손 AD의 슬하에 15세손 AJ, AK이 있었고, 피고 종중에서는 AJ의 아들인 16세손 ‘AH’의 자손들을 큰댁 계열로, AK의 아들인 16세손 ‘AI’의 자손들을 작은댁 계열로 구분하여 불렀으며 큰댁계의 후손으로 19세손 ‘AL’, 작은댁계의 후손으로 20세손 ‘AM’, ‘AN’, ‘AO’이 있었다(별지 각 세계도 참조). 그런데 원고들이 속해 있는 큰댁계의 AL 후손들은 피고 종중의 회장(AP, P) 및 감사(AQ, AR 등 임원직을 수차례 역임한 바 있을 뿐만 아니라, 피고 종중 소유의 여러 부동산에 관한 명의수탁자로 되어...
