1. The Defendant’s KRW 533,279,915 as well as the Plaintiff’s KRW 15% per annum from March 22, 2018 to May 31, 2019.
Reasons
Basic Facts
A. A. A contract for construction works between the Defendant and C Co., Ltd. (hereinafter “C”) is the Defendant around May 2016 and C Co., Ltd. (hereinafter “C”).
B) As between B and C, the Defendant’s construction of the building located in Ulsan-gu D (hereinafter “instant construction”) was called the “instant construction,” and the building newly built as the instant construction is called the “instant building.”
(2) The contract for construction works (hereinafter referred to as the “instant contract”) with a major content set forth below to be awarded a contract;
A) The name of the construction project: The date of commencement of the construction project for the new construction project for the neighboring facilities: The date of the completion of the project for the construction project for the Jung-gu Seoul Metropolitan City on May 25, 2016: the contract price for the completion of the project for the completion of the project on April 30, 2017: The contract price for the construction project for the neighboring facilities (Won8,700,000,000) - C, including value-added tax, failed to complete the instant construction project by April 30, 2017, which is the due date stipulated in the said contract for the construction project; the Defendant and C, around April 30, 2017, extended the due date stipulated in the said contract for the construction project; and C entered into a modified contract (hereinafter referred to as “instant modified contract”) with the following major contents, such as changing the contract price to KRW 7,777,777,000,000:

9. The rate of warranty bond for construction work (%) and the rate of warranty bond for construction work on February 10, 199: 20/1,000 of the daily contract amount per each delay and the date of commencement and completion of construction work shall be stipulated in the contract.
