A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. Intrusion into buildings, theft, fraud, or violation of the Specialized Credit Financial Business Act;
A. On November 30, 2013, at least 12:30 on November 30, 2013, the Defendant came before the E Hospital managed by D, the representative of the victim in Jongno-gu Seoul, Jongno-gu, Seoul, and came into the said hospital, and went into the said hospital, thereby infringing on the victim’s structure.
B. At around 12:30 on November 30, 2013, the Defendant: (a) stolen a copy of a credit card in the foreign exchange bank located in the victim’s holding market value of the victim’s holding company located on his/her own, with the victim F’s seated at 9201 room; (b) on November 30, 2013, 200,000 won of the market value of the victim’s holding company located on his/her own, and its smartphone case.
C. At around 13:40 on November 30, 2013, the Defendant purchased tobacco, etc. equivalent to KRW 6,650 in the “H convenience store” operated by the victims under the Jongno-gu Seoul Jongno-gu Seoul Metropolitan Area G, and subsequently, presented the credit card in the said F’s name, as indicated in the foregoing paragraph (b), to settle the price of goods 6,650 won, and used a stolen credit card and received goods, such as tobacco, etc. from the victims belonging thereto, at least 6,650 won, and acquired the stolen credit card over 17 times as indicated in the attached Table No. 1 through No. 3, as indicated in the attached Table No. 1 to No. 3, using the stolen credit card and received public transportation services, such as buses, equivalent to KRW 12,850, and acquired financial benefits or received goods equivalent to KRW 11,050 from the victims.
2. Violation of the Specialized Credit Financial Business Act, such as entering buildings, entering buildings, fraud, and attempted fraud;
A. On March 29, 2014, around 15:00, the Defendant: (a) thought that money and valuables would be stolen before the above E Hospital managed by the victim D; (b) entered the hospital through the door of the above hospital to intrude the victim’s structure.
B. At around 22:00 on March 29, 2014, the Defendant: (a) around 22:00, in the hallway of the instant hospital located at the 7th floor of the main office of the hospital; (b) on the part of the victim I, who was located on the kart, located on the kart; (c) KRW 1,00,000 in cash, equivalent to 30,000 won;
