Reasons
Punishment of the crime
On June 10, 2015, the Ulsan Central Headquarters of the National Democratic Trade Union Federation (hereinafter “the Ulsan Central Headquarters”) held a meeting to urge employees belonging to the KTK vessel to compensate for delayed payment of wages. During the above meeting, two employees of the KTK vessel were arrested in flagrant offender under suspicion, such as obstruction of performance of official duties, and entered the Ulsan-dong Police Station’s cell located in the Ulsan-dong Police Station located in 11, Ulsan-dong, Ulsan-dong, U.S. (D) from around 10:0 on June 11, 2015 to urge the release of two employees, such as the above C, from the parking lot of the Ulsan-dong Police Station (hereinafter “instant meeting”).
Meanwhile, from October 1, 2003 to September 30, 2007, the Defendant served as the head of the Ulsan District Department, and from March 13, 2012, the contractual public official who is in charge of the head of the Ulsan District G, who is a public official belonging to the Ulsan District. The Defendant participated in the instant assembly.
1. No one shall intrude any police officer for a considerable time without any justifiable reason, destroy, conceal, move or remove any line for keeping order established by the chief of the competent police station in violation of the Assembly and Demonstration Act, or impair the utility thereof by any other means, notwithstanding police officers' warning;
Nevertheless, on June 11, 2015, the Defendant discovered the maintenance line of plastic materials installed at the entrance of the above parking lot in order to prevent the participants of the meeting of this case from getting out of the above parking lot, which is the place of assembly reported in advance by the participants of the meeting of this case, at around 10:00, the Defendant laid down one of the maintenance line of order at the above parking lot and laid down on the floor.
Accordingly, the defendant has harmed the utility of the maintenance line set up by the chief of the Ulsan East Police Station by other means.
2. The Defendant of the obstruction of performance of official duties shall add a line to the order keeping line immediately after cutting down one of the above order keeping lines on the floor, such as the date, time, and place mentioned in the preceding paragraph.
