A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On or before March 6, 2013, the Defendant made a false statement to the victim C, who traded the Internet Capital, stating that “The Internetnet Mar. 1, 2013 was secured by KRW 300,000,000, and will sell in KRW 220,000.”

However, even if the defendant receives money from the victim, he did not have the intention or ability to send capital.

Nevertheless, the Defendant, by deceiving the victim as above, received 220,000 won from the victim’s new bank account under the name of the Defendant on the same day.

2. On April 19, 2013, the Defendant posted a notice on the Internet NAB website E Cafbook bulletin board, stating that “I will sell beer sppers (beer)” on the part of the victim F who reported and contacted the Defendant, “I will send the things if you transfer KRW 50,000 to the Defendant.”

However, even if the defendant received money from the victim, he did not have the intention or ability to send the goods.

Nevertheless, the Defendant deceivings the victim as above and received 50,000 won from the victim’s account in the name of the Defendant on the same day.

3. On December 28, 2012, the Defendant: (a) connected the Internet site NV G car page at the Nam-gu Incheon Metropolitan City PC; (b) reported that “I would sell two copies of the powder to KRW 60,000 if I sent the powder value” by contacting the victim with the victim.

However, even if the defendant receives the money from the victim, he did not have the intention or ability to send the money.

Nevertheless, on December 30, 2012, the Defendant, by deceiving the victim as above, received 60,000 won from the victim to the account of community credit cooperatives under the name of the Defendant.

4. On December 26, 2012, the Defendant supplies for young children using Internet NAV in the mutual influence room located in Nam-gu Incheon Metropolitan City D.
