Defendants shall be punished by imprisonment for five years.

Seized evidence Nos. 1, 5 through 14 shall be confiscated by Defendant A.

Punishment of the crime

Defendant

A and Defendant B are not authorized to import or administer psychotropic drugs, so they shall not import or administer Metephopopics (one philoopopon; hereinafter referred to as "phiopons").

1. The Defendants’ co-principaled Defendants under the direction of the “C” and the “D” in the name-free type of penphones located in Thailand and the “D” in Korea. Defendant A entered his domicile in the address of his own mail, and conspired to receive the postal item in which the penphones are enclosed, and Defendant B then sealed the penphones from Defendant A to the “D” and then sent them to the “D”.

On January 8, 2020, the Defendants: (a) stated five boxes concealed by inserting 105.84g grophone 105.84g gramphones in 54 gramphones to “E; (b) stated the destination as “E”; (c) sent to the Republic of Korea through international special grade mail, which is the address of the Defendant A; and (d) on January 8, 2020, the said mail arrived at the Incheon central provision port located in the Jung-gu Incheon Metropolitan Government Port, Jung-gu, Incheon, as G, around 04:14.

On January 15, 2020, Defendant A received postal items on which the instant phiphonephone was enclosed from the front of the F in the 10:50 on the 15th of the Papju, and Defendant B had been the same place for the purpose of sending D the phiphone to “D” by putting the phiphone from Defendant A around 12:50 on the same day.

Accordingly, the Defendants, in collusion with “C” and “D”, imported phiphones into the Republic of Korea.

2. Defendant A

A. A. Around January 13, 2020, the Defendant violated the Act on the Control of Narcotics, etc. (flavoring) administered a philopon in a way that the Defendant puts the philopopon into a glass pipe in the Defendant’s residence located in Pakistan F, and inhales the smoke emitted from the glass pipe by heating the blopon with a glass plate.

(b) Any foreigner violating the Immigration Control Act may sojourn in the Republic of Korea within the limits of his/her sojourn status and sojourn period.
