A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On July 2016, the defendant became aware of the victim D (V, 32 years of age) through the victim's male-friendly arrest C around July 2016.

1. Compulsory indecent acts;

가. 피고인은 2016. 8. 12. 02:30 경 ∼03 :00 경 사이에 대구 달서구 E에 있는 F 대학 근처에 있는 G의 원룸에서, 피해 자로부터 ‘ 배에 가스가 찼으니, 가스 좀 없어 지라고 배를 만져 달라’ 는 부탁을 받고, 누워 있던 피해자의 배를 만지다가 갑자기 피해자의 왼쪽 허벅지 부위를 2∼3 회 쓰다듬어 피해자를 강제로 추행하였다.

The Defendant attempted to rape in a large room of L in Daegu-gu K and 106 dong 107 around August 12, 2016, at around 05:50, and around 106 dong 107, and the Defendant tried to commit rape by putting the victim on two occasions and putting the victim on the floor.
