1.The judgment of the first instance shall be modified as follows:
The defendant shall pay to the plaintiff KRW 61,500,000 as well as to the plaintiff on September 2014.
Reasons
1. Basic facts
A. From November 19, 2009 to April 22, 2010, the Plaintiff paid a sum of KRW 61,500,000 to the Defendant via the Defendant’s name account as indicated in the following table 1 (hereinafter “instant first payment”).

B. From May 25, 2010 to December 25, 2011, the Plaintiff paid a sum of KRW 107,000,000 to the Defendant via the Defendant’s name account as indicated in the following table 2 (hereinafter “instant 2 payment”). The Plaintiff paid the instant 1 and 2 payment, including the instant 1 and 2 payment, to the Defendant.
