Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. 피고인은 2013. 7. 23. 인천 남구 주안동에 있는 상호불상의 PC방에서 인터넷을 통하여 네이버 중고나라 카페에 접속하여 분유를 판다는 내용의 글을 게시한 후 이와 같은 게시글을 보고 연락한 피해자 B에게 “돈을 송금하면 후디스 프리미엄 퀸3단계 6캔을 택배로 배송해 주겠다”라고 거짓말 하였다.

However, even if the defendant receives the price of goods from the victim, the defendant did not have the intention or ability to deliver the share.

The Defendant, by deceiving the victim as such, received KRW 115,00 from the victim to the Agricultural Cooperative Account under the name of the Defendant as the price for the goods from the victim, and acquired it by fraud.

2. On October 31, 2013, the Defendant posted a notice stating that he/she would sell bebudio by accessing NAVVacacks online at the PC room near the main station located in the Nam-gu Incheon Metropolitan City, Nam-gu, Incheon, via the Internet, and concluded that he/she would deliver bebudio to the victim C who reported and contacted such posted notice, “When remitting money, he/she will deliver bebudio to be delivered to a door-to-door.”

However, even if the defendant receives the price of the goods from the victim, the defendant did not have the intention or ability to deliver the bee studio.

As such, the Defendant, by deceiving the victim, received 40,000 won from the victim’s seat to the agricultural bank account under the name of the Defendant, and fraudulently acquired it.

3. The Defendant made a false statement to the victim D, who reported a notice stating that he sells bebudio as above at the time and place specified in paragraph 2, stating that “When remitting money, he/she will deliver bebudio to be delivered to be a door-to-door.”

However, even if the defendant receives the price of the goods from the victim, the defendant did not have the intention or ability to deliver the bee studio.

As such, the Defendant deceivings the victim, and thereby, from the victim, KRW 50,00,00 to the Agricultural Cooperative Account under the name of the Defendant for the use of goods.
