A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

피고인은 2018. 11. 17. 21:55경 안동시 B에 있는 자택에서 술에 취한 상태로 소란을 피우던 중, “최근 아들이 술을 마시고 집에 들어와 폭언을 일삼아 왔는데 금일도 술을 많이 마시고 들어와 소리를 지르고 하여 너무 힘이 드니 동행하여 진정을 시켜달라.”는 피고인 어머니의 방문신고를 받고 출동한 안동경찰서 C지구대 소속 경위 D, 경장 E으로부터 소란을 피우게 된 경위에 대하여 질문을 받자, “내가 뭘 잘못해서 경찰관이 집까지 찾아와서 나에게 이러냐, 너네 어디서 왔냐, 내집에서 소리 지르는게 잘못 되었냐, 너네가 뭔데 가정사에 관여를 하냐, 도대체 누가 신고를 했냐 씨발.”이라고 소리를 지르며 위 E의 몸을 손으로 밀치는 등 폭행하고, 이를 제지하려는 위 D의 멱살을 잡는 등 폭행하였다.

Accordingly, the defendant interfered with the legitimate execution of duties of police officers on the maintenance of public peace and order.
