Defendant

B is the only part of the victim D(n, 13 years of age), and the defendant A is the person who is the victim's mother with the remaining part of the female living together of the defendant B.

1. Defendant A entered the large room of Defendant A’s residence located in Sinpo City from June, 2008 to July, 13:00, where Defendant A reported television with the private villages (the eight years old at that time) and entered the small room.

A은 그곳에서 피해자를 안고 손을 옷 속으로 넣어 피해자의 가슴과 음부를 만지고 피고인의 혀를 피해자의 입 안에 집어넣고, 피해자가 ‘나는 싫으니까 하지 마세요’라고 말하는데도 이를 무시하고 피해자의 손을 잡아 피고인의 성기를 만지게 하고, 계속해서 피해자의 몸 위로 올라가 자신의 성기를 대고 피해자의 음부에 비볐다.

2. Defendant B

가. 피고인 B은 2012년 4월 초순경부터 같은 해 5월 하순경 사이 어느 날 22:00경 목포시 F아파트 304동 206호에 있는 피고인 B의 주거지 방에서 피해자(당시 11 ~ 12세)를 이불 안에 같이 눕도록 한 후 손을 옷 속으로 넣어 피해자의 가슴과 음부를 만지고 피해자가 ‘아빠 하지 마세요, 싫어요, 저 아빠 싫어요’라고 말하는데도 이를 무시하고 피해자의 손을 잡아 피고인 B의 성기를 만지게 하고 계속하여 성기를 피해자의 음부에 비볐다.

As a result, Defendant B had kinship and committed an indecent act by force against a victim under 13 years of age.

B. From Jun. 23, 2013 to Jun. 29, 2013, Defendant B, at around 22:30 days from Jun. 23, 2013, had the victim (the age of 13 at that time), she was in the room of the residence indicated in the above paragraph (a), who was in the same manner as the victim, exceeded the victim, and let the victim be placed on the side of Defendant B, she was placed in the hand, and only stored the victim’s chest and sound part, and the victim did not refuse to do so.
