Defendant
A and B shall be punished by imprisonment for eight months, and by imprisonment for four months, respectively.
provided that this ruling has become final and conclusive.
Reasons
Punishment of the crime
1. Defendant A and Defendant B were employed as a daily worker of E Co., Ltd., the injured party D’s subcontractor, and conspired with the victim’s cable scrap (electric wires good at the time of electrical construction) owned by the injured party, which was kept in custody in the construction site at the construction site, to cut off the cable scrap (electric wires good at the time of electrical construction) to sell them on the water and on the water.
On July 20, 2013, at around 19:00, the Defendants cut the gap in which the surveillance was neglected due to the leaving time of all the parts in the construction site, and cut it to a good size to move cable scrap owned by the victim that was kept at the said construction site using a spacker (electric cuter) and a manual cuter that was in the said construction site, and then moved back to the H seal flobbbbbbs.
After all, the Defendants, together, stolen 1,440km of cable scrap amounting to KRW 9,590,400.
2. Defendant C is an employee of Company I who is entrusted with guard and access control of Company D.
On July 20, 2013, at around 23:00, the Defendant: (a) held a stolen cable coops, such as the preceding paragraph from A; (b) received a request from A to undergo an entrance inspection; and (c) exercised influence over the entrance coops that A and B stolen cable coops, so that they may not be immediately deducted.
After the defendant informed A to leave the D3 questions, the defendant asked B to be able to leave the workplace outside of A and B with the D3 questions on his own vehicle.
As a result, the Defendant, in combination with A and B, assisted by facilitating the crime with knowledge that he steals another's property.
