A defendant shall be punished by imprisonment for not less than one year and six months.

The evidence seized shall be confiscated by the accused as referred to in subparagraphs 6 through 11.

Punishment of the crime

On May 8, 2008, the Defendant was sentenced to one year of imprisonment for larceny, etc. and two years of suspended sentence. On April 1, 2016, the Daegu District Court sentenced the Defendant to three months of imprisonment for embezzlement, etc., and completed the execution of the sentence on May 21, 2016.

On May 30, 2016, the Defendant: (a) discovered one bicycle 70,00,000 won in the market value of the victim’s name, which is owned by the victim, set up at a park near the Daegu Suwon-gu Public Security Center; (b) cut off the locking device into the back seat of the said bicycle; (c) cut off the locking device by using any creb that has not been supervised by the victim; and (d) cut off the bicycle in total of KRW 13,020,000,000 from that time until July 21, 2016.

Accordingly, the defendant habitually stolen the victims' property.
