1. Defendant A shall be punished by imprisonment for a period of eight months.
However, the above sentence shall be executed for two years from the date of the final judgment.
Reasons
Punishment of the crime
Defendant
A and B are teachers of E Child Care Center in Dobong-gu Seoul Metropolitan Government, and Defendant C is the head of the above Child Care Center and is the person obligated to report child abuse.
1. Defendant A, at around 12:20 on April 12, 2018, committed physical abuse that harms the physical health and development of a child, such as the victim’s chest, from around 13:18 on March 15, 2018 to April 12:20, on the ground that the victim’s F (e.g., 2 years of age) was not drinking well, Defendant A committed emotional abuse that harms the mental health and development of a child at least six times in total, as indicated in Nos. 1 to 6 of the above crime list (1).
2. From March 7, 2018 to April 13:44, 2018, Defendant B committed emotional abuse that may harm the mental health and development of children over 12 times in total, such as the list of crimes in the attached Table (2) from March 7, 2018 to April 13:4, 2018, such as covering the face of the victim G (or the age of 2) who was enjoyed in the classroom of the E Child Care Center tobacco leafs of the E Child Care Center.
3. Defendant C
A. The Defendant violated the Child Welfare Act is the director of the E-child care center, and the Defendant’s employee A and B committed physical and emotional abuse against the child as described in the above paragraphs 1 and 2.
B. On March 22, 2018, the Defendant violated the Act on Special Cases concerning the Punishment, etc. of Child Abuse Crimes (Aggravated Punishment of Child Abuse by Persons Engaged in Child Welfare Facilities, etc.) (Aggravated Punishment of Child Abuse by Persons Engaged in Child Welfare Facilities) committed a physical development and development of the child’s body from that time to April 13:21, 2018, as described in the No. 1 of the List of Crimes (3) No. 20199, Apr. 2, 2018, for the following reasons: (a) the victim G (nick, 2 years of age) was dissatisfied with his/her friendship in the classroom of the above Child Care Center He/she raised a dispute with his/her friendship.
