The sentence of sentence against the defendant shall be suspended.
Reasons
Punishment of the crime
The Defendant is a pharmacist who operates an “E pharmacy” as a lessee of the building C and D in Gyeonggi-si, Gyeonggi-si, and Gyeonggi-do, and F is a manager of the building B, and G is a sectional owner of the building H and I and a person who is delegated by J and K with the management of the said commercial building.
Around February 2018, F was requested from the above G to peruse the said B Building Management Rules, and the said G was required to obtain and keep a power of delegation in the name of the sectional owner in order to verify the right to peruse the said G.
The Defendant and the owner L of the above Category C and D had disputes over “M pharmacy” operated from February 8, 2018 from the above H and I, such as filing an application for provisional disposition of business suspension, and the Defendant was willing to find the above B building management office to verify whether G was delegated with the above J and K with the authority to manage the commercial buildings.
A personal information manager shall not provide a third party with personal information without the consent of the subject of information, and no person shall be provided with such personal information with the knowledge of the situation.
Nevertheless, on February 19, 2018, the Defendant demanded the Director of the Management Office of the building B to present “G’s power of attorney” to the Director of the Management Office, and the said F displayed the power of attorney stating the name, date of birth, and address of the personal information of J, K, and G, and the said F refused the Defendant’s demand that the said F would make a copy of the power of attorney, the Defendant taken the said power of attorney to cellular phone using the said F’s letter of attorney.
Accordingly, the Defendant was provided with personal information of J, K, and G by way of viewing the power of attorney and photographing the cell phone with knowledge that the Defendant did not obtain consent from the said F, a personal information manager.
