Defendant A Co., Ltd. shall enter and leave the Plaintiffs listed in the [Attachment 1] Nos. 1 to 31 of the Plaintiffs’ list.
Reasons
1. Basic facts
A. The Defendants are companies whose business purpose is urban bus transportation business, etc., and the Plaintiffs are drivers who were employed or worked for each of the pertinent Defendant stated in the entry date and claim amount table in attached Form 2, and the “affiliated date” column on each of the pertinent dates.
(Plaintiff N,O, P, Q, S, R, T, U,V, W, and X, respectively, retired from each of the relevant Defendant stated in the entry date and claim amount list as of the corresponding date, and “affiliated” as of the corresponding date, respectively. (hereinafter “retirement Plaintiffs”)
The main contents of each of the instant collective agreements and wage agreements between the Plaintiffs and the Defendants are determined by collective agreements, wage agreements, and labor-management agreements, etc. entered into between the Y organization branch, AAAB headquarters C&K regional headquarters (hereinafter “trade union”) and AC business partnership (hereinafter “business partnership”) to which the Defendants, other than Defendant C and Defendant C, belong. The main contents of the instant collective agreements and wage agreements from 2009 to 2012 (hereinafter collectively referred to as “each of the instant collective agreements and wage agreements”) are as follows.
1) The working system and the working hours shall be two full-time per day; the working hours after a morning shall be based on 14:30; the number of monthly working days shall be 22 days per basic working day (20 days for February, 21, and 21 days for leap year) and 24 days (22 days for leap year and 23 days for leap year); the working hours shall be 8 hours per day for basic working day, 1 hours for 40 hours per week basic working day, 5 hours for leap year, and 9 hours per day for extended working day (two hours for leap year and two hours for leap year).
The completion of working hours shall be made in accordance with the allocation table.
