A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant is a person who is engaged in driving a car with Bsch Rexroth, in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents.

On April 12, 2017, the Defendant driven the said van without obtaining a driver's license from around 09:10 on April 12, 2017, while driving the said van and driving it on the side of the State in Kimhae-si, and driving it on the road in front of 144 km on the Highway at the direction of the air-conditioning point at the end of the emergency.

In accordance with road traffic conditions and the structure and performance of the vehicle, drivers of motor vehicles shall not drive motor vehicles at a speed or in such a manner as to inflict any danger and injury on others, and have a duty of care to prevent accidents in advance by safely reporting the traffic situation.

Ultimately, the Defendant suffered injury to the victim C, the victim G (53) who was the passenger, and the victim E, respectively, by the occupational negligence as above.

2. Violation of the Road Traffic Act (Non-licenseless Driving) Defendant 1, without obtaining a driver’s license as stated in the above paragraph 1, driven a vehicle B from the front side of the Defendant’s house located in the north-gu in Busan metropolitan area to the 144km point in the main road in Kimhae-si, Nam-do. The Defendant 2 driven a vehicle B from the section of about 30km to the 144km away from the main road in Busan metropolitan area.
